    It seems to be the case, as the agreement resolves "all disputes." I'm sure there is a stipulation that Creative agrees not to pursue patent claims against Apple in the future.

    Which is why the whole "Creative won" argument doesn't wash. Considering that iPod will end up generating tens of billions of dollars in future revenue for Apple (on top of the billions it's already made), settling for $100 million is not exactly a sign of Creative dealing from a position of strength.

    I mean think about it. Creative is basically claiming Apple stole its goose that lays golden eggs. Apple says "No, we didn't, in fact, you stole our spinning wheel that can spin threads of gold from straw!" They both argue and threaten each other, but in the end Apple offers Creative a little piece of golden eggshell, and Creative is so happy about winning, it tells Apple, "Aww, shucks, thanks for the piece of shell, you can keep the goose!"

    I don't think so. :P

    Which is why the deal has all the signs of Creative gulping down its pride and accepting a settlement on Apple's terms. Creative accepted because if it didn't, the chances were quite high that it would not be in business a year from now, mainly because Zune will wipe out its ability to sell in a crowded market. At least now, it has a big stick it can use against Microsoft.

    In the end, it's a big win for Apple.

    The iMacs will NEVER see Kentsfields. Apple would have to have put Conroe in the new iMacs for that even to be a remote possibility. Even if they had I would still say it would never get Kentsfields.

    I mean people are saying that Conroe is too hot for the iMac as it is (I don't think they are) but Kentsfield is two Conroe dies on one package. Meaning almost double the power consumption and heat generation.

    Close, Manic Mouse. I dont understand people's belief that every Intel chip made has to go into an Apple machine. I doubt the Conroe will be used in any Mac nor the Kentsfield. The range is covered, and I'm sick of these silly rumors of Mac mid towers.

    There wont be a mid tower, not now, not "Next Tuesday".

    I would think that the decision isn't necessarily the "generic-ness" of the term "App Store", rather the real test (IMHO IANAL) is the pervasiveness of the term before Apple decided to brand their product as such. While it may be simple to say "well heck, it's an app store, of course they'd call it the app store". One could argue that apps (short for applications) has been around forever. The word "store" and it's meaning as well. However, given that the two terms are common and the function of the store is not unique, that no one up until this point has used the term generically (note use of the term, not necessarily that someone has actually tried to apply it to a business) shows that the combination of the two terms in this context is indeed unique.

    At least that would be my argument :)

    No, VNC displaying the entire screen from the computer and Apple has a built in VNC server in their OS. This is a matter of taking the icon images themselves and using them for another purpose in a client/server application rather than in an app running on the mac itself. It is a clear case of copyright infringement. RA could have avoided all of this by simply providing their own licensed icons.

    @guet: You should read what you wrote. You are proving yourself wrong with your own points. They are licensed for use on a mac, not for distribution to a client machine be it an iphone, Blackberry or Android.

    You say that but it's not necessarily true. One of my apps was rejected for depicting an image of an Apple product. Not a copyrighted file, mind you. Just a little icon, drawn by me, that looked like an Apple product. It was rejected for depicting an Apple trademark.

    It is likely that Apple will drop conroes into the iMac when kentsfield is released. It makes sense to put merom into the iMac now as an intermediate update as they do not have to redesign the whole logic board. Maybe around MWSF we will see a new iMac based around conroe with pin compatible kentsfield in the high end models (24"). I still think it is unlikely that Apple will bring out a mid level tower any time soon, but i've been wrong before. Still would be nice to be able to pick up a quad core 24" iMac in 6 mounths time.

    Of COURSE Apple was infringing on the patent if you assume it was a valid patent. I'm saying the patent never should have been granted because it's not something you can patent.

    That might be so. But Apple has lots of questionable patents as well. Is the Click-wheel REALLY an innovation worth patenting? "We have a wheel, and we have buttons. Why not conbine them?". IIRC, they are also patenting the Mag-Safe, even though similar systems have been used for long time in pressure-cookers (IIRC).

    And finally, to answer your statement in the first paragraph: This is EXACTLY why the patent system IS messed up.

    Because Apple lost? Yes, patent-system IS messed up. But Apple is taking advatange of it as well. Now that Apple lost, everybody complains, yet no-one complains when Apple files for obvious patents as well.

    iTunes Movie Store should be rental only.

    If you really love a movie, go out and buy it. This way, you have the physical copy to carry around with you where ever you want to watch it (living room, friend's house, car, ect)

    I think the notion that Apple is trying to get is like this senerio:
    Somebody who is bored on a Friday night with nothing better to do, who does not feel like driving out to the local video rental store. Howabout being able to download it on your computer for $4.99 for a 5 day rental.

    I would probably pay that. Apple figures if you want decent quality, hook your Mac Mini up to your HDTV and play it off there. If not, just watch it on your Mac.

    If you copy it to an iPod, the movie will expire in 5 days as well. Or, it will expire next time you connect your iPod to iTunes. (people HAVE to do that!)

    We'll probably see Front Row 2.0 as well.

    I think that Apple would make their phone a GSM phone to get more worldwide market rather than releasing it on CDMA. And I doubt they'd throw in 3G on a GSM phone because Cingular's 3G network is not the biggest right now. I think I read that Sprint's PowerVision is the biggest at the moment and still growing. T-Mobile just bought a TON of 3G bandwidth but isn't launching that until next year. So I don't think 3G would be in this phone because we aren't quite there......yet.

    As for UMA, I'd be surprised if it didn't have a Wifi card. There are a lot of rumors saying that T-Mobile's launching a giant UMA service, which I wouldn't be surprised with the 7,000 wireless networks they own.

    Ya, i know 3G isnt that popular in America, but i expect the iPhone at least should have built-in WiFi like many Phones in today's market. So we can use the iPhone to video LIVE chat with the other Mac users or iPhone users through the internet. Since many Universities have Wi-Fi covered the whole school, so i think it will benefit abot students. And more and more hot-spot now.

    This from Intel's Technology Brief on Thunderbolt Technology:

    Users can add high-performance features to
    their PC over a cable, daisy chaining one after another, up to a total
    of 7 devices, 1 or 2 of which can be high-resolution DisplayPort
    v1.1a displays (depending on the controller configuration in the host
    PC).

    So does this mean 3 external monitors once we can daisy chain? (I'm assuming one is the internal display.)

    Well, it would surprise me. USB3.0 and Thunderbolt will come included in Intel''s Ivy Bridge. Apple would have to add more hardware and disable USB 3.0 to make it 2.0 only. Makes zero cents.

    They wouldn't have to add more hardware. USB3.0 is backwards compatible with 2.0. They would only have to disable 3.0 protocols somehow. Given they need a driver to make the hardware work this wouldn't be at all difficult, IMO; they have shipped iPhones with 802.11N hardware and limited it to G protocol/speeds so they already have a history of doing such things so I wouldn't put it past them. I KNOW if they got Blu-Ray drives somehow included with their hardware (i.e. only thing available), they would STILL not support it except in DVD/CD mode. Apple will do what they think is best for them NO MATTER WHAT. They don't give a flying rat's hind end about what the consumer wants. Steve thinks he knows better than anyone and he has a whole army of groupies telling him he's right so how on earth could he ever imagine otherwise?
