NSC has an interesting way of working. Oct 06 cases are pending and they are approving Dec 06 cases.... never think of predicting what govt is (in)capable of :D
Look at Sayantan's signature, he is EB-1, not EB-2. EB-1 I-140 cases at the NSC, are a bit ahead of EB-2.

check with your lawyer. you should be able to ue the same labor unless the laws have changed. It is my understanding that if you file an MTR right away you get to retain your LABOR CERTIFICATION and that then allows you to file another I140 under EB3

I think next month its predicted that the Visa numbers will move forward and then retrogress again...so in October(next financial year) again there may be forward movement..what do you guys think!

I think there is a possiblity that they might not cross check you G325A with the consulate becuase DOS purges non immgrant applications whihc are one year old. Since there are so many applications filed by the time they go for this check your data may have been purged ( this is a very high possiblity ) as by the time this request is made it would december or so . As i heard that TSC will issue recipts by Oct End ,beofer cross checking g235A there are many checks and many other processes they need to follow. So this is a possiblity.

Submit the I-94 when you board the flight that leave USA, in your case, Chicago, Not Miami, It is always not advisable to sumbit when you are boarding a connecting, non-Internation flight. For example, what if the International flight is cancelled or you missed, you will be in US, but have already returned your I-94 Also always have copies of all the I-94 for records.

US born citizens cannot deported. But naturalized citizen can be deported, if he obtained immigration (GC) by frudalent means (false documents, sham marriage, by cheating.. etc).

Just heard this from my friend. His case is exactly the same (I140-NSC approved, July 2nd 9:01 R.Mickels filer). His got transferred to Texas and got receipts last week. No EAD's yet. Got receipt for FP date today.

I know someone who went to Canada for the weekend and got the I-94 with the correct date on it.
Note that the airline (AA), on his way out of the US, was not willing to take his I-94 since he was going for less than 30 days. So he had to explain to them about his situation and they took it.
Also note that if you have an Indian passport, you will need a visa to go to Canada.
The other option to extend your I-94 is for your employer to refile I-129, and request for extension of stay. This can be done using premium processing.

I plan to transfer PD from EB3 to EB2.
My EB3 RIR was approved. The job description required BS and nothing else. I-140 hasn't been filed yet.
MY EB2 PERM was filed and pending. The job description required Master and nothing else.
I obtained the Master degree even before filing EB3.
Now, I plan to file the 1st I-140 based on my old LC. My attorney said it would be approved without any problem.
Then, I plan to file the 2nd I-140 based on new LC and request PD carryover. My attorney said that I would have problem at this time. Since both LCs belong to the same company and both have the same job title - Software Engineer. And, they have different job requirement.
Any more comments?
