Employers need to have already declared whether their sponsoring of H1B's result in use of available numbers or exempted from it. They need to substantiate, I believe, with tax documents among other things. The applicant, or USCIS does not decide the category; rather, USCIS can deny an application if it deems an organization, and/or rarely, a position, is NOT 'not for profit': Eg. fully non-profit RD wing of a commercial company rarely gets
designated as non-profit and the H1B's are mostly within the cap.

Universities, goverment agencies, university medical hospitals are well-known examples that fit this description. Private sector organizations will not qualify in most cases. I am going for an InfoPass appointment tomorrow and thought of asking the members is the following questions seem appropriate. I dont expect the officer to answer all/any of them..but just thought of listing them..incase I get lucky and get a helpful officer.
- Is my case with an IO desk?
- Since when is it with an IO desk?
- if and when my background check updated?
- is background check same as IBIS check? If not then is IBIS check complete?
- if and when my FBI name check completed?
- is review awaiting some response from external agency
(Consulate post/FBI/BCP)?
- If under "additional review" What kind of "additional review" is it under?
- Expected time-frame for the additional review to be complete?
- Is it being actively worked on or just assigned to an officer and not updates?
- Is it being transferred to other/local office? Is any interview being planned?

I have a hypethetical situation
1. Say in the election Dems get both house and Senate AND
2. No compromise happens in CIR at Lame Duck Session too. Also
no SKILL passes too AND
3. New winners Sworn in and its congress controlled by Dems.
Now what is the status of the CIR that was passed in the senate and
that house bill passed? Does it expire or go annul? Or can these
new members come a compromise on that? What could be the attittude of the congress member towards it? It would be really interesting to know the
legal sides and political attittude of lawmakers to it.

Hi,
My mother-in-law is coming to US on 2nd Dec on a one-way ticket, she will be going back around March 09 i.e. in almost 4 months.
As we dont know abt the dates as such of return so we have booked a one-way ticket from India to US.
Will there be any problem due to that at port of entry?
Do she also need to carry travel insurance along with her?

Buy a two way ticket with future date and adjust the later according to her comfort. With one-way ticket, your in-law will have a problem in convincing a POE officer that she will return. Do the math!

I think you are getting slightly confused here. The thing under discussion in this thread has always existed as a clause in the bill and is nothing new. The F4 is a separate provision which was struck down today. The 3 year for STEM provision still exists separate. Please have a look at the details of the bill. It should be available somewhere on this website.

I think I know what the company means, I have been in the position. My previous company went through lot of layoffs and they are still. But the point here is, they are strictly following the lawyers words, i.e. when a company layoffs and if they are planning to make your friend permanent i.e. start his green card process, then technically during layoffs if the skill-set matches they should offer your friends job to the supposed to be layed off people, now if the company went thru layoffs in the last 6 months, then they should reach the previously layed off people with matching skill-set and offer them the positoin. Basically the company is getting rid of some bad blood also during layoffs so they don't really want to offer them any positoin, so they would rather wait and start GC process for your friend 6 months from the last layoff. The above reply I got from my previous company lawyer (so don't quote me on this) is similar to what your friend got.

I have never heard about this before, but if I were you I would:
1. Immediately request transcripts from college in sealed envelope, exactly as requested.
2. I dont think sending notarized copies will work, because notaries normally dont attest document, owner of the document does that and they just say that it is your signature. As per my understanding you will need to send the originals as requested. But with it you can safely send a letter asking them to send the documents back. Include a prepaid fedex envelop.
Worst case, they will loose these documents but you can get them reissued from university. But if you dont send documents as requested your application could be denied.

I am stuck out side of US for my name check for last 9 months when I applied for my H-1. I have approved I 140. is there any way I can file my I 1485 and Advance parole or any thing to get back into US.
Some one has told me that I can use consular processing but have no idea about that.

(b) Will they allow you to file I-485 before your visa number is available.
(c) How stable would be your job be in comming years
(d) What year of your H1 B are you in.
1) If you do not have a problem in H1b extension then.. new Perm Labor in 6 months... (a) I-140 in one month if premium ---- b) if they say no premium you have to wait, how long can't say)

b) Eb num increases but no I-485 until date becomes current.

Myself and my spouse are on H1b. I am on H1b(industry) and my Spouse H1b is through non-profit.
Please let us know how best we can be a backup for each other in case of any unavoidable circumstances.
a)If I get laid-off or fired, can I jump to H4 and then come back to H1b without being subjected to cap?
b)What are the other backup plans we can have.
